Wrongful Termination and Workplace Disputes
Retaliation. You are protected from retaliation after:
- Reporting illegal conduct, discrimination, or sexual harassment
- Disclosing a disability
- Requesting an accommodation for a disability
- Requesting or taking a state or federally protected leave related to a disability, to care for a sick family member, or after the addition of a new child to your family
- Suffering a workplace injury
- Taking state and federally protected rest and meal breaks, as well as breaks to express milk following the birth of a child
Discrimination based on a protected status. Your employer cannot treat you differently than similarly-situated peers on the basis of your race, color, creed, religion, national origin, sex, marital status, disability, public assistance status, age, sexual orientation, familial status, or gender identity.
Discrimination based on a state or federally protected leave. If you are entitled to take leave related to a workplace injury, a disability, to care for a sick family, or after adding a child to your family, your employer cannot treat you differently than similarly-situated peers who did not need leave.
Hostile Work Environment. You employer and colleagues cannot subject you to intolerable workplace conditions on the basis of your race, color, creed, religion, national origin, sex, marital status, disability, public assistance status, age, sexual orientation, familial status, or gender identity.
Failure to Accommodate. If you have a disability that requires an accommodation, your employer must engage in an interactive process to determine whether your disability can be accommodated.
Wage Theft. Your employer must pay you at least minimum wage for all hours worked and 1.5 times your usual wage for all hours worked above and beyond 40 hours in a single week. Your employer must also pay you if you work through rest or meal breaks.
